1. Acceptance
These Terms of Use (“Terms”) govern your use of thanoslink.com, the Thanos Link mobile application and cardholder portal (the “App”), and related services provided by 16886973 Canada Inc., operating as Thanos Link (“Thanos Link”, “we”, “us”). By using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
Your prepaid card and the funds on it are governed by the Cardholder Agreement with the Issuer. If these Terms conflict with the Cardholder Agreement regarding the card or funds, the Cardholder Agreement prevails. Businesses that sponsor a card program are governed by their Program Agreement with Thanos Link.
2. Our role
Thanos Link is a program manager and technology provider. We operate the App and portal, onboard cardholders and Partners, and facilitate communication with the Issuer. We are not a bank and do not hold your funds. Cards and accounts are issued by licensed financial institutions and regulated issuers; funds are held by the Issuer.
3. Eligibility and your account
- You must be at least 18 years old and a resident of a country where the Services are offered.
- You must provide accurate, complete and current information and complete identity verification before a card is activated.
- You are responsible for keeping your login credentials, device and PIN secure and for all activity under your account. Tell us immediately if you suspect unauthorized access.
- One account per person. You may not open an account on behalf of someone else without authority.
4. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose, or in connection with money laundering, terrorist financing, fraud, gambling where prohibited, or any activity prohibited by the Issuer or payment networks.
- Provide false information or impersonate another person.
- Interfere with, reverse engineer, scrape or attempt to gain unauthorized access to the App, portal or any system connected to them.
- Use the Services in a way that could harm Thanos Link, the Issuer, a Partner or other users.
We may suspend or close your account, and the Issuer may suspend or cancel a card, where we reasonably believe these Terms, the Cardholder Agreement or applicable law have been breached, or where required by law or a regulator. Remaining funds are handled under the Cardholder Agreement.
5. Fees
Fees for cards and transactions are set out in the Cardholder Agreement and fee schedule provided to you when your card is issued, and in the App. Partners’ fees are set out in their Program Agreement.
6. Intellectual property
The App, website, Thanos Link name, logo and all related content are owned by Thanos Link or its licensors and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute or create derivative works from them.
7. The App and app stores
The App is licensed, not sold. If you download it from the Apple App Store or Google Play, you also agree to that store’s terms. Apple and Google are not responsible for the App, its content or support, and have no obligation to you regarding it. You are responsible for any data charges and for keeping your device’s operating system up to date. We may update, change or discontinue features of the App at any time.
8. Third-party services
The Services rely on Issuers, payment networks, identity-verification providers and other third parties. We are not responsible for their acts or omissions, and your use of their services is subject to their terms. Links to third-party websites are provided for convenience only.
9. Disclaimers
The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or secure, or that information in the App is always accurate or up to date.
10. Limitation of liability
To the fullest extent permitted by law, Thanos Link and its directors, officers, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising from or related to the Services, even if advised of the possibility. Our total liability for any claim relating to the Services is limited to the greater of CAD $100 and the fees you paid to Thanos Link in the twelve (12) months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable consumer-protection law, including in Quebec.
11. Indemnity
You agree to indemnify and hold harmless Thanos Link from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Services, to the extent permitted by law.
12. Term and termination
These Terms apply for as long as you use the Services. You may stop using the App at any time and close your account through the App or by contacting us. We may suspend or terminate your access as described in section 4. Sections 6, 9, 10, 11, 13 and 14 survive termination.
13. Governing law and disputes
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. The courts of the judicial district of Montreal, Quebec have exclusive jurisdiction over any dispute, except that nothing prevents a consumer from bringing a claim in the courts of their own province where the law so provides.
The parties have expressly required that these Terms and all related documents be drawn up in English. Les parties ont expressément exigé que les présentes conditions et tous les documents connexes soient rédigés en anglais.
14. Changes and contact
We may update these Terms. The “last updated” date shows the current version; material changes will be notified in the App or by email before they take effect. Continued use after a change means you accept it.
